Terms of service.

Please read these Terms of Service ("Terms") carefully. They govern your use of appsbycb.com, your appsbycb account, our store and the apps we publish (the "Services"), operated by Carlos Baez ("appsbycb", "we", "us").

1. Agreement

By creating an account, placing an order, downloading an app or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Services.

2. Eligibility

You must be at least 13 years old to use the Services, and old enough to form a binding contract where you live (or have a parent or guardian's permission) to place an order.

3. Your account

• Give accurate information and keep it up to date.
• Keep your password secure; you're responsible for activity under your account. We recommend turning on two-factor authentication.
• Tell us right away at [email protected] if you suspect unauthorized use.
• One person per account. Accounts may not be shared, sold or transferred.

4. App licenses

When you check out an app — free or paid — we grant you a personal, non-exclusive, non-transferable, revocable license to download, install and use it on devices you own or control, for your personal use, under these Terms. Apps are licensed, not sold. You may not:

• Copy, redistribute, resell, rent or publicly share our apps or download links.
• Reverse-engineer, decompile or modify our apps, except where the law expressly allows it.
• Remove any copyright or proprietary notices.

Apps obtained through Google Play are also subject to Google Play's terms.

5. Orders & pricing

Prices are shown in U.S. dollars at checkout and may change at any time, but changes won't affect orders you've already placed. Free items still go through checkout so they're added to your library. We may refuse or cancel an order — for example, because of a pricing error, suspected fraud or an item becoming unavailable — and will refund any payment in that case.

6. Payments

Paid orders are charged through our payment processor (such as Stripe) when you check out. You confirm you're authorized to use the payment method you provide. Applicable taxes may be added at checkout.

7. Refunds & cancellations

• Digital items and apps: if a paid app doesn't work as described, contact us within 14 days of purchase and we'll help fix it or issue a refund.
• Physical goods: unused items may be returned within 30 days of delivery for a refund of the item price. Damaged or incorrect items will be replaced or refunded at no cost to you.
• When an order is fully refunded or cancelled, access to its downloads is removed from your library.
• In-app tips made through Google Play are handled under Google Play's refund policy.

Nothing here limits any refund rights you have under applicable consumer law.

8. Physical goods

We ship to the address you provide at checkout. Delivery estimates aren't guaranteed. Title and risk of loss pass to you when the item is delivered to the carrier. You're responsible for any import duties or taxes for international orders.

9. Acceptable use

You agree not to:

• Break the law or violate anyone's rights using the Services.
• Attempt to access accounts, data or systems you aren't authorized to access, or bypass download protections.
• Interfere with the Services, including with malware, scraping at abusive rates, or denial-of-service attacks.
• Use the Services to send spam or impersonate others.

10. Our content

The Site, apps, logos, text, graphics and blog posts are owned by appsbycb and protected by copyright and trademark law. You may share links to our pages and quote short excerpts with attribution, but you may not otherwise copy or reuse our content without permission.

11. Measurements & accuracy

Some of our apps, like Measure It, estimate real-world measurements using your device's camera and sensors. Results depend on your device, lighting and surfaces and may not be exact. Don't rely on them for safety-critical, medical, legal, construction or other uses where precise measurements matter — use a calibrated tool instead.

12. Third-party services

The Services rely on third parties such as Google Play Services for AR, Google Play, Stripe and Cloudflare. Their services are governed by their own terms and privacy policies, and we aren't responsible for them.

13. Disclaimers

The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Services will be uninterrupted, error-free or compatible with every device.

14. Limitation of liability

To the fullest extent permitted by law, appsbycb will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some jurisdictions don't allow these limits, so they may not apply to you.

15. Indemnity

You agree to defend and hold harmless appsbycb from claims, damages and expenses (including reasonable legal fees) arising from your misuse of the Services or violation of these Terms.

16. Suspension & termination

You can stop using the Services and ask us to close your account at any time. We may suspend or close accounts that violate these Terms or put other users at risk. Sections that by their nature should survive (such as licenses already restricted, disclaimers and limits of liability) survive termination.

17. Governing law & disputes

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. Any dispute that can't be resolved will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. If you live outside the U.S., you keep any mandatory consumer protections of your country.

18. Changes

We may update these Terms. We'll post the new version with a new effective date and, for material changes, notify account holders. Continuing to use the Services after changes take effect means you accept them.
